Heard learned counsel for the petitioners and learned Government Pleader for the respondents. counsel for the petitioners submits that the property admeasuring to an extent of Ac.0.38 y2 cents in Sy.No.494/4B, Ac.0.77 cents Sy.No.494/4A, Ac.0.1974 cents in Sy.No.494/4C and Ac.0.1974 cents in Sy.No.494/4D situated in Bodumalluvaripalli village, Piler Mandal, Annamayya District was originally purchased by the husband of the 2"'' petitioner through a

registered sale deed dated 28,01.2015. Since then, petitioner No.2 has been in peaceful possession and enjoyment of the subject being any interference legal heirs noticed that the said Properties List. Learned counsel for the petitioners further submits the petitioner No.1 herein purchased the that on 29.01.2022, said property for a valid sale
consideration and submitted a document for registration before respondent No.4. Accordingly respondent No.4 allotted document bearing P.No.15 of 2022 and later, the said document is returned on the ground that the sale deed affects land which is classified as Dotted/ Government/ DKT land falling under clause (a) of the Section 22-A(1) of the Registration Act, 1908. Hence the registration of the document is refused under Section 71 of the Act.

Learned counsel for the petitioners further circumstances, some similarly situated submits that in similar persons approached this Court and
W.P.No.21437 of 2023 and this Court vide order dated 22.08.2023
disposed of the writ petition. Hence, the learned counsel for the petitioner requested to dispose of this writ petition in similar lines. The relevant portion of the said order reads as follows; filed
“In the considered opinion of this Court, the view of the 4 respondent that the refusal order dated 24.12.2021 has not been set aside by the competent authority cannot be sustained, in the facts and circumstances of the case. Accordingly, the refusal order dated 24.12.2021 is set aside, declaring that the same, in view of the subsequent developments is of no consequence. The writ petition is accordingly disposed of with a direction to the the document/ sale deed document dated 20.10.2021 of the petitioners and take 4'^ respondent to receive P. No. 206/021 necessary action in the light of the proceedings of the 2 dated 14.07.2023 and the consequential notification nd respondent deleting the subject matter property from the prohibited category list, and release the same, if it is othenwise in compliance with process the provisions and Stamps Act and Registration Act, within a period (04) weeks from the date of receipt of a copy of this

order dated 22.08.2023 passed by this Court in W.P.No.21437 of 2023, this Court is of the considered view that the present writ petition can be disposed of, with the following directions;
4. on i) Refusal order dated 04.02.2022 issued by respondent No.5 is hereby set aside. The petitioners herein are
directed to re-submit the P.No.15 of 2022 to the respondent authorities, particularly, respondent No.5 within a period of three (03) weeks from the date of receipt of a copy of this
order.
