[2025:RJ-JP:29441] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 9901/2019 Roshan Kumawat S/o Mahesh Kumawat, Aged About 26 Years, R/o E-2, Vijay Nagar Murlipura, Jaipur (Raj.) ----Petitioner Versus 1. University Of Rajasthan, Through Its Registrar, J.l.n. Marg, Jaipur. 2. Controller Of Examination, (B.ed Part-Ii Examination- 2019) University Of Rajasthan, J.l.n. Marg, Jaipur. 3. Principal, Sidhi Vinayak T.t. College, B-7, Karni Niwas Scheme, Behind Rochees Watch Co. Road No. 14, V.k.i. Area, Jaipur. ----Respondents For Petitioner(s) : Mr. Narendra Kumar Saini For Respondent(s) : Mr. Pawan Pareek Mr. Vishesh Sharma for Mr. Y.C. Sharma HON'BLE MR. JUSTICE AVNEESH JHINGAN Order 01/08/2025 1. This petition is filed seeking directions to the respondent to issue admission card for appearing B.Ed. Part-II examination to be held in 2019 and to declare the result of the petitioner after submitting the internship certificate. 2. Brief facts are that the petitioner qualified in Pre-Teacher Education Test held in the year 2017 and was allotted Siddhi Vinayak Teachers Training College, Jaipur. The petitioner passed B.Ed. Part-I and was to undergo internship programme in the year 2018-19 in Government Senior Secondary School Nindar, Jaipur. The admit card of the petitioner for B.Ed. Part-II was not uploaded [2025:RJ-JP:29441] (2 of 3) [CW-9901/2019] due to short attendance and not completing the internship. Hence, the present petition. 3. While issuing notice of motion on 31.05.2019, the petitioner was permitted provisionally to appear in B.Ed. Part-II examination. 4. Learned counsel for the petitioner submits that the petitioner had met with an accident and could not complete the internship. Communication dated 20.05.2019 is relied upon to contend that internship completion certificate is not required to be submitted prior to B.Ed. Part-II exams and can be submitted afterwards. 5. Learned counsel for the respondent-University contends that the petitioner had not gone for internship even for one day and attendance in the regular classes was of fifteen days out of two hundred ten working days. The contention is that the provision of University of Rajasthan (Ordinance 323) minimum 80% attendance is required for all course work and practicum and 90% for internship. 5.1. It is further argued that the communication dated 10.05.2019 relied upon was an advisory issued by Principal Joint Secretary School Education to publish instructions that internship is a pre requisite for appearing in B.Ed. Part-II and can be completed after appearing in exam but these were not acted upon and no instructions were issued. 6. The contention of learned counsel for the petitioner relying upon communication dated 10.05.2019 need not be gone into. In view of the undisputed fact that the attendance of the petitioner in all course and practicum was 7.14% and 0% in internship thereby the petitioner was not eligible to appear in B.Ed. Part II examination. [2025:RJ-JP:29441] (3 of 3) [CW-9901/2019] 7. Another aspect to be considered is that though a bald statement has been made that the petitioner had met with an accident but no medical record was produced. 8. In absence of having failed to meet the requirement of minimum attendance as stipulated in Ordinance 323, no case is made out for interference in the writ jurisdiction. 9. The petition is dismissed.
