The matter comes upon for consideration of this interlocutory application preferred on behalf of the applicants under Section 5 of the Limitation Act, 1963 with the prayer to condone the delay of 290 days occasioned in preferring the connected writ appeal. Office note indicates that neither A/D card nor unserved notice in respect of the respondent No.1 has been received, however, vakalatnama is filed on behalf of the respondent No.1 by Mr. K.P. Pathak, Mr. B. Das and Mr. C. Paul, Advocates. Service is, therefore, complete. Mr. S.C. Keyal, learned counsel appearing for the applicants has submitted that the delay in filing the connected writ appeal was not intentional and the same was occasioned on account of official procedure. Mr. K.P. Pathak, learned counsel appearing for the contesting respondent No.1 has not seriously opposed the application. Having heard the learned counsel for the parties and after going through the contents of the application, we deem it appropriate to condone the delay occasioned in preferring the connected writ appeal. Hence, the interlocutory application is allowed and the delay of 290 days occasioned in preferring the connected writ appeal is condoned.
Page No.# 3/3 Registry is directed to register the connected writ appeal and list the same for admission on 26.05.2025. Accordingly, the instant Interlocutory Application is disposed of.
