This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of CrMP No. 4358 of 2019 to its original file. Learned counsel for the petitioners submits that the CrMP No. 4358 of 2019 was dismissed vide order dated 06.09.2024 for non-compliance of the order of filing of consolidated Criminal Miscellaneous Petition within the stipulated period. Learned counsel for the petitioners submits that due to inadvertence, the order could not be complied in time, which resulted in dismissal of CrMP No. 4358 of 2019. It is further submitted that the petitioners have very good grounds to agitate in this case and unless the same is restored to its original file, the petitioners will be highly prejudiced. Hence, it is submitted that CrMP No. 4358 of 2019 be restored to its original file. Learned Addl. P.P. has no serious objection for the prayer of restoration. Considering the facts of the case and the aforesaid submission of the learned counsel for the petitioner, CrMP No. 4358 of 2019 is restored to its original file to the stage, at which, it was before its dismissal.
