HON'BLE MR. JUSTICE MANEESH SHARMA
Order 22/05/2025
1. The instant bail application has been filed under Section 439 of Cr.P.C. on behalf of the petitioner, who has been arrested in connection with FIR No.68/2023 registered at Police Station Vaishali Nagar, Alwar for the offence punishable under Sections 8, 20, 29 of Narcotic Drugs and Psychotropic Substances Act, 1985.
2.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the alleged recovered contraband (Ganja) is marginally above the prescribed commercial quantity. He further submits that the petitioner is in judicial custody since 11.10.2023. He further submits that out of 22 witnesses, only 3 have been examined so far and the trial of the case will take considerable time, therefore, further custody of the petitioner would not serve any fruitful purpose.
[2025:RJ-JP:21519] (2 of 2) [CRLMB-6939/2024]
3. Learned Public
Prosecutor
has opposed the
submissions made by the learned counsel for the petitioner and submitted that the petitioner was found in possession of Ganja which is above the commercial quantity. Therefore, considering the rigour of Section 37 of the NDPS Act, the petitioner should not be enlarged on bail.
4. Heard and considered the contentions made by the learned counsel for the parties and perused the material available on record.
5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by the learned counsel for the petitioner, as also the fact that the alleged recovered contraband (Ganja) is 20.950 kgs which is above commercial quantity, considering the rigour of Section 37 of NDPS Act and looking to the gravity of the offence and nature of allegation levelled against the accused petitioner, I do not consider it a fit case for grant of bail to the accused petitioner.
6. The bail application under Section 439 Cr.P.C. is accordingly dismissed.
7. The observations made hereinabove is only for the decision of the instant bail application and would not have any impact on the trial of the case in any manner.
8. However, petitioner would be at liberty to approach this Court after the statement of Ashok Kumar (PW-20).
