JUSTICE A. GUNESHWAR SHARMA O R D E R 03.10.2025 [1] This matter is taken up as unlisted item due to involvement of urgency. [2] Present Mr. M. Devananda, learned senior counsel for the petitioner and Mr. H. Devendra, learned Deputy Advocate General for the State. [3] The petitioner is recorded as pattadar and owner in possession of land under Patta No. 647 (Old), 347 (New) under Dag No. 153 under Revenue Village No. 87(A) – Khwai Bazar, Imphal West. He is aggrieved by impugned order dated 16.09.2025 issued by Sub Divisional Officer (SDO), Imphal West, thereby directing 201 Pattadars to remove structures constructed over the Government Patta Land. No. 160 of the impugned order dated 16.09.2025, where he has been alleged to have crossed the Government Dag No. 145. By the impugned order, the unauthorized occupants/enchroachers be evicted from the enchroached portions of State land w.e.f. 20.09.2025 for self-removal of enchroachments and if not complied with the order, the authority will remove w.e.f. 26.09.2025. [4] It is submitted that petitioner has apprehension for removal of structures constructed over the patta land due to the impugned order issued by the SDO, Imphal West, Manipur. The petitioner has submitted 2(two) representations dated 02.09.2025 stating that this structure has been constructed over the patta land allotted by the State authority and it has also been stated that no notice has been received for issuing the impugned order. [5] Mr. M. Devananda, learned senior counsel for the petitioner submits that before initiation of eviction and demolition in terms of the impugned order, the portion of the enchroament alleged against the petitioner may be verified by giving opportunity of being heard the petitioner. [6] Mr. H. Devendra, learned Deputy Advocate General for the State submits that it was on-going a mass drive of eviction from their patta land. Eviction and demotion of has been done after proper verification. [7] This Court is the opinion that after submission of the learned senior counsel for the petitioner, this writ petition is disposed of by directing the State respondents by giving opportunity of being heard the petitioner P a g e 3 | 3 to ascertain the exact enchroachment of land against the petitioner at Sl. No. 160 of the impugned order dated 16.09.2025 issued by the SDO, Imphal West, Manipur. Eviction and demolition, if any, done after proper verification of the enchroachment alleged against the petitioner and the petitioner be granted opportunity of being heard. [8] The possession and structure of the petitioner within the patta land under Dag No. 153 is protected.
