The petitioner claims to be appointed on contract basis as Medical Officer Ayush for the Community Health Centre, Farah, district Mathura. It is submitted that such contract employees are appointed for the particular Community Health Centre and they cannot be transferred . It is also submitted that the controversy involved in the matter is no more res integra in view of the judgment of this Court in the matter of Writ Petition No. 14433 of 2023, Shalini Kumari v. State of U.P. and 3 Others dated 29.08.2023. Learned Standing Counsel does not dispute the above fact. In view of aforesaid, in the light of judgment of this Court in the case of Shalini Kumari (supra), the order of transfer of the petitioner dated 30.4.2022 and consequential order of relieving dated 1.02.2025 are hereby quashed.
