A case has been registered against the petitioner herein/accused I No.4 and other accused for the offences punishable under sections 191 (2),191 (3),118 (1), 351 (2) read with 190 of the Bharatiya Nyaya Sanhita, 2023 (for brevity {BNS'). 3. Brief facts of the case of prosecution are that, there occurred a quarrel between son of the c/e facfo complainant and accused No.1 in front of a brandi shop near Sai Baba Temple, . Narukuru on 08.04.2025 and that accused No.1 beat the son of de facfo complainant and abused him in filthy language and then, son of de racfo compla'lnant left the place and later, accused No.1, his father v,-z. Penchalaiah, one Venkata Krishnaiah along with some others, wearing helmets went to the house of de facfo complainant and called the son of the .de racfo complainant, abused him and when de facfo complainant intervenecI\,`\`accused No.1 beat him with an iron rod on his head and the other accused c<,,rgr - =*-_'= pelted stones .on their house and when the neighbour v,-z, Venkateswarlu came and tried to pacify the issue, the accused abused him and beat him with rod and on hearing cries of the villagers, all the accused left the place. Basing on the strength of statement of de facfo complainant, recorded by police on o9.04.2025, police registered a case in Crime No,112 of 2025 of Totapalli Gudur Police Station and investigated into. 4. lt is the contention of the petitioner/accused No.4 that all the allegations are leveled as against accused No.1 and there is no specific allegation as against the petitioner/accused No.4. The petitioner/accused No.4 is falsely implicated into the crime. Hence, the petitioner/accused No.4 prays {o grant anticip-atory bail. 5. Heard. Perused the record. 6. A perusal of contents of the statements Of the de faCfo cdmplainant recorded by police goes to show that there iS specific accusation as against accused No.1 and in respect of petitioner/ accused No.4 and two other accused are concerned, they Were alleged to have pelted stones on the house Of the de faCfo 'complainant. Pr,'ma fac,'e as can be seen from the record, the injury sustained by the de facfo complainant is simple in nature. Apparently, accused Nos.5 to ll have already been enlarged on E= |`' i, EE \x`` LL- bail. ln view of the aforesaid facts and circumstances, this court tis inclined to grant anticipatory bail to the petitioner/accused No.4, on certain conditions. 7. Accordingly, in the event of the arrest of petitioner/ accused No.4 in the above crime, he shall be enlarged on bail on his executing personal bond for a sum of Rs.10,000/-(Rupees ten thousand) with two sureties for the like sum each to the satisfaction of the arresting police officials. Further, the petitioner/accused No.4 shall appear before the Station House Officer, concerned once in a week ,-.e, on every saturday between 10.00 a.m. and 2.00 p.m. till filing of the charge sheet and further, the petitioner/accused No.4 shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses. 8.
