Ramesh Chand and others vs. State of H.P. and others Civil Revision No. 175 of 2023 27.08.2025 Present: Mr. Ajay Sharma, Sr. Advocate, with Mr. Tarun Brakta, Advocate, for the petitioners. Mr. B.N. Sharma, Additional Advocate General for respondent No.1/State. Mr. Sanjay Kumar Sharma, Advocate, for proposed LR-10(a). Respondents No. 2 to 5, 7 to 17, 19 to 23 and 25 to 30 proceeded against ex parte vide order dated 12.3.2024. CMP No. 1512 of 2025 Heard counsel for the parties. Perused the pleadings. The applicants in the case at hand were proceeded against ex parte vide order dated 12.3.2024. The present application has been filed for setting aside the ex parte order dated 12.3.2024. For the sufficient cause shown, delay in filing the application for setting aside ex parte order dated 12.3.2024 is condoned. It is well settled law that being proceeded ex parte means ex parte for the day and not for the entire proceedings. The respondent is free to joint proceedings at any stage. In this regard, reference can be made to Sangram Singh vs. Election Tribunal, Kotah and another, AIR 1955 SC 425. In view of the aforesaid, ex parte order dated 12.3.2024, whereby the applicants have been proceeded against ex parte is recalled and applicants are permitted to join the proceedings. Application stands disposed of. Civil Revision No. 175 of 2023 Petitioner No.2 is stated to have died. Learned counsel appearing on behalf of the petitioners submits that an appropriate for bringing on record the legal heirs of deceased petitioner No.2 stands filed, however, the same is not on record. The same be placed on record, if in order. List after two weeks. (Bipin C. Negi) Judge August 27, 2025 Tarun
