UNNI KRISHNAN NAIR 21.04.2025 (Vijay Bishnoi, CJ) The matter comes upon for consideration of the instant Interlocutory Application [I.A.(Civil) No.3981/2024] filed on behalf of the applicant with the prayer to condone the delay of 226 days occasioned in filing the connected writ appeal. Looking to the controversy involved in the connected writ appeal, we have heard the learned counsel for the applicant finally on merits of the connected writ appeal, wherein the impugned order passed by the learned Single Judge is under challenge. Learned counsel for the applicant, after arguing the matter for quite some time, on instruction, has submitted that he may be allowed to withdraw the instant Interlocutory Application as well as the connected writ appeal, which is yet to be registered. However, he seeks liberty to the applicant to avail appropriate remedy available to him under the law. In view of the submission made by the learned counsel for the applicant, the instant Interlocutory Application [I.A.(Civil) No.3981/2024] as well the Page No.# 3/3 connected writ appeal, which is yet to be registered [WA No.13129/2024 (Filing Number)] stands dismissed as withdrawn with the liberty, as prayed for.
