Issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 25.03.2023 passed by the respondent no.2 (Annexure no.11 to the writ petition). ii. Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to consider for granting compassionate appointment to the petitioner according to his qualification, in the institution namely Mahatma Gandhi Intermediate College Sakhawaniya, District Kushinagar or in any other institution in District Kushinagar, within the period to be stipulated by this Hon'ble Court." 2. Learned counsel appearing on behalf of the petitioner submitted that the present case is covered by judgment passed by Co-ordinate Bench of this Court vide order dated 27.04.2024 in Writ-A No. 5248 of 2024 (Praveen Kumar Pandey Vs. State of U.P. and 4 others). It is prayed that the present matter may be disposed of in the light of paragraph nos. 17 and 19 of the said judgment. 3. Learned Standing Counsel appearing on behalf of the State-respondents opposed the writ petition but has not disputed the aforesaid submissions made by learned counsel for the petitioner. 4. In view of the aforesaid submissions, the impugned order dated 25.03.2023 passed by respondent no.3, District Inspector of Schools, Kushinagar is set aside. The respondent no.3, District Inspector of School, Kushinagar is directed to re-consider the entire matter and pass an appropriate and reasoned order in the light of the aforesaid judgment, in Versus Counsel for Petitioner(s) : Ramesh Chandra Dwivedi Counsel for Respondent(s) : C.S.C.
