Petitioner was engaged as Beldar during the years 1993-94 by the then Shimla Development Authority. Petitioner alongwith others preferred Anita Verma & Ors Vs. H.P. Housing & Urban Development Authority & Ors2. Pursuant to the orders passed in the said writ petition, services of the petitioners were regularized as Junior 1 Whether reporters of Local Papers may be allowed to see the judgment? yes 2 CWP(T) No. 5896 of 2008, decided on 16.03.2011 - 2 - Draftsman w.e.f. 16.07.2007. In this writ petition, petitioner seeks a direction to the respondents for giving him benefit of Rakesh Kumar Vs. State of H.P. and Ors3 for regularizing his services/ conferring work charge status upon him on completion of eight years’ of service i.e. from the year 2002 instead of 2007. 3. Learned counsel for the petitioner submits that the issue involved in the writ petition and the reliefs prayed for by the petitioner are now covered by the decision rendered by the Hon’ble Apex Court in The State of Himachal Pradesh & Ors. Versus Surajmani & Anr.4. Learned counsel further submits that the petitioner would be satisfied in case the respondents are directed to examine his case in light of the aforesaid judgment within a fixed time schedule. Learned counsel for the respondent is not averse to this prayer. 4. Having regard to the afore-submissions, but without examining the merits of the matter, this writ petition is disposed of with direction to the respondents/ competent authority to consider and decide the case of the petitioner in 3 CWP No. 2735 of 2010, decided alongwith connected matters on 28.07.2010 4 Civil Appeal No.1595 of 2025, decided alongwith connected civil appeals on 06.02.2025 - 3 - accordance with law laid down in Surajmani4 and pass appropriate order in accordance with law within six weeks from today.
