arguments of Sri Nuthalapati Krishna Murthy, Advocate for the Petitioners and Public Prosecutor for the Respondent, the Court made the following;
±EiiiriiE======e=!l3r ORDE.R:- This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short [the BNSS') has been filed on behalf of the petitioners/accused Nos.1 to 5 to grant anticipatory bail in connection with Crime No.152 of 2025 of Kovur Police Station, SPSR Nellore District. 2. A case has been registered against the petitioners herein/accused Nosl to 5 and other -'accused for the offences punishable under Sections 333,115 (2),118 (1), 351 (2),137 (2), 127 (2) read with 3 (5) of the Bharatiya Nyaya Sanhita, 2023 (for 'brevity [BNSJ). 3. Br-lef facts of the Case of prosecution are that, about one year prior to 30.04.2025, the c/e facfo complainant met with an accident and had been in Coma and subsequently recovered and discharged from Vijaya Hospital, Chennai and returned home; that subsequent to his returning home, the de facfo complainant que.stioned accused Nos.1 to 5, who being his wife and his daughters and sons ,of de facfo comp'ainant's brother, about cash of Rs.2,00,000/-, promissory notes, bank cheques and also about transfer of Rs.7,46,000/- through his phonepe account, but they gave irrelevant-answers; that when negotiations were going at `~/ \ -\- I i.
village, on 30.04.2025 at about 9.30 p.m. all the accused along with some others, criminally trespassed into the house and beat the de facfo complainant with hands and legs and also with an iron rod, caused swelling injuries'to his left knee; that all the accused kidnapped the de facfo complainant, took him to Tatichetlapalem village of Bogole Mandal and wrongfully confined; that the de facfo complainant escaped from their clutches and reported the incident to police on 26.05.2025. A case in Crime No.152 of 2025 of Kovur - Police Station was registered against the accused for the aforesaid offences and investigated into. 4. Learned counsel for the petitioners/accused Nos.1 to 5 would contend that the petitioners did not commit any-offence muchless the alleged offence; that the de facfo complainan{ being addicted to vices, in order to harass the petitioners, they being his w'ife, daughters and accused Nos.4 and 5, being the sons of c/e facfo complai'nant]s brother, foisted this false case. 5.
Learned Special Assistant Public Prosecutor for the State would contend that the investigation is still pending and if the petitioners were granted pre-arrest bail, there would be every apprehension to the life of the c}e facfo complainant, as he being the husband of accused No.1 and father of other accused. c,/
6. Heard. Perused the record. 7. A perusal of accusation made agaI-nSt the Petlltl'OnerS goes to show that the de facfo complainant suffered an accident and he went into Coma and thereafter, he was given treatment and he recovered from coma and when he returned home, he observed that the promissory notes and documents were not to be seen I-n hI'S room. It is further alleged that an amount of Rs.7,46,000/- was transferred by his elder daughter through his phonepe to her phon'epe account. 8. A perusal of the record goes to showthatthe de facfo complainant lodged a report to the poll-Ce alleging that on 30.04.2025, the petitioners/accused Nos.1 to 5 were alleged to have entered into the room of the cfe facfo complainant and beat him with hands and legs, resulting which, the de racfo complainant sustained simple injurI'eS. Thereafter, when the petitioners/accused Nos.1 to 5 wrongfully confined hI'm at a place situated at Thatichetlapalem, he escaped from them and reported the case to police. 9. A perusal of contents of the report goes {o showtha{ the petI-tl'Oner Nos.1 to 3 are none other than his wife and daughters and accused Nos.4 and 5 are none other than the sons A ,,t]`.ri,I. ` wh-±,,`
of his brother. Pr,-ma fac,'e it appears that there were some family disputes amongst them. ln view of the aforesaid facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioners/accused Nos.1 to 5, on certain conditions. 10.
Accordingly, in the event of the arrest of petitioners/ accused Nos.1 to 5 in the above crime, they shall be enlarged on bail on their executing personal bond for a sum of Rs.10,000/- (Rupees ten thousand) each with two sureties for the like sum each to the satisfaction of the arresting police officials. Further, the Petitioners/accused Nos.1 to 5 shall cooperate with the investigation and further, they shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. ll.
