Petitioner (Sumit Nayyar), a practicing lawyer of this Court, had petitioned in Court in public interest to command the respondents to improve/modernize the work and infrastructural facilities of all the cremation grounds in Jammu. As also, to improve the infrastructural facilities at cremation ground Jogi Gate, Jammu. 2. Ex facie, the petition is pending for the past over five years. The records show that pursuant to the numerous orders passed by this Court from time to time, the respondent-Authorities have submitted various affidavits/status reports, indicating the works that have been executed. 3. We have examined each of those reports and upon perusing the records, we are of the view that although it’s a work in progress but the petition has substantially served its purpose. 4. Upon being pointedly asked, the learned counsel for the petitioner, as always, fairly submits that in the wake of the various affidavits submitted by the Sr.No. 31 2 WP(C) PIL No. 04/2020 authorities, indicating the progress and the works that have been carried out, nothing substantive survives in the petition and the same be disposed of as having been rendered infructuous. 5. Accordingly, we close the proceedings in this petition. However, in the event any fresh cause of action arises in future, the petitioner shall be at liberty to either move an appropriate application in this petition itself for its restoration and necessary orders or file a fresh petition. 6.
