The petition coming on for hearing, upon perusing the petition and the grounds fI-led Ion support thereof and upon hearing the arguments of sri ARRABOLU SAI NAVEEN, Advocate for the petitI'Oner and of PUBLIC PROSECUTOR for the Respondent and the court made the following;
ORDER: This Criminal Petition under sections 480 and 483 of B.N.S.S., has been filed by the petitioner/A4, seeking regular bail in Cr.No.1/2025 of Koyyuru Police Station, AIIuri Sitharama Raju District. 2. The above said crime was registered against the petitioner herein and others for the offences punishable u/Secs.111(2)(b) of the a.N.S. and u/Sees.20(b)(ii)(C), 25, 8(c) of the NDPS Act. 3. Case of the prosecution, in brief, ,'s that, on o9.01.2025 at about 9.00am, on receipt of credible information with regard {o illegal possession and transportation of ganja, the sub-Inspector of police, along with staff and mediators conducted vehicle checking. They found four persons coming in Bolero vehicle and on seeing police, the said four persons stopped the vehicle and tried to run away, Then police apprehended one of them whereas three others were escaped. on enquiry, he disclosed his identity particulars as that of A4 and police found 417 kgs of ganja in his possession. Police arrested him and remanded to judicial custody and seized the contraband and he confessed the involvement of other accused. 4. Learned counsel for the petitioner contended that the petitioner has been in judicial custody from o9|01.2025 and most of the investigation is completed and after expiry of statutory period, police have not filed charge sheet. As such, the petitio'ner is entitled for statu{or`, bail.

On the other hand, learned Assistant Public Prosecutor has not' disputed the said facts but fairly confirms non-filing of charge sheet by the police even after statutory period is completed, but opposed to grant bail. 6. Heard both sides. 7. Given that the petitioner has been in remand Since 09.01.2025, this court views that most of the investigation concerning the petitioner's role in the commission of the alleged offence has likely been concluded. lt has been submitted that the petitioner has permanent abode and there is no \ credible apprehension of him fleeing away from justice. Additionally, since most of the witnesses are official witnesses, the release of the petitioner J :; WOuld not impede the investigation Or tamPer With the evidence and in View .'\ `.,` J' `r4*li.`,*,< /. of seizure of huge quantity of contraband, imposing stringent conditions 'would meet the ends of justice. 8- In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/A4 with the following conditions. (i) The petiti6ner/A4 herein shall be released on his executing a personal bond for Rs,1,00,000/-(Rupees one lakh only) each with two sureties for a like sum each to the satisfaction of the learned I Additional District & Sessions Judge, Visakhapatnam; (ii) on release, the petitioner shaI, appear before the Station House officer concerned on every sunday between lO.00 a.m. and 01.00 pm for a period of four (04) months. s``- . _ .ng off
