Heard the parties.
The petitioner has been made accused in connection with Balumath P.S. Case No. 130 of 2024, for the offences registered under Sections 103(1), 3(5) of the B.N.S, 2023, pending in the Court of learned C.J.M., Latehar.
Petitioner happens to be the husband of the deceased Sajra Khatoon, who died in her matrimonial home due to asphyxia because of hanging.
It was submitted that though the case was instituted under Section 103(1) of the B.N.S., but chargesheet has been submitted under sections 85, 108 of the B.N.S. It was submitted that no material has come in the case diary to show the reason why the deceased has committed suicide. It was also submitted that petitioner was not present at Balumath when the deceased committed suicide.
Mr. Sardhu Mahto, learned A.P.P. assisted by Ms. Olia Begum,
learned counsel for the informant have opposed the prayer for bail. In view of the submissions made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Latehar, in connection with Balumath P.S. Case No. 130 of
2024.
