JUSTICE ASHOK KUMAR JAIN Order 11/08/2025 1. These applications for bail filed under Section 483 of BNSS by the applicants-accused Jagveer Singh S/o Shri Samudra Singh, Ranjeet Singh S/o Shri Hargyan, Arjun Singh S/o Shri Durga Singh and Bhupendra Singh Alias Chotu Banna S/o Shri Raghuraj Singh in FIR No. 35/2025 dated 05.05.2025 registered at P.S. Kaithunipol District -Kota City, whereby the applicants- accused were charged under Sections 189(4), 333, 308(2) (5), 111(2)(b) and 111(4) of BNS. 2. The applicants were arrested and are in judicial custody since their arrest. The Court below has dismissed the bail application. 3. Learned counsel for the applicants relying upon grounds raised in bail applications submits that the applicants are innocent and falsely implicated in the present case. Further, he submits that the investigation relating to present applicants-accused is complete and are no more required by the Investigating Agency for investigation. He further assures that in case, the applicant-accused are required for further investigation, the applicant-accused will be available for such investigation. He also submits that the investigation/trial will take its own time and no purpose will be served by keeping the applicants-accused in custody. 4. Learned counsel for petitioner submitted that petitioners were neither named in the FIR nor any role or involvement [2025:RJ-JP:31596] (3 of 4) [CRLMB-7377/2025] of these petitioners were explained by any of witness recorded by police under Section 180 of BNSS. He further submitted that these petitioners are nowhere connected with any gang or any organized crime. He further submitted that one of the accused Mahendra Puri, who is named in report and having criminal background is released by learned Sessions Judge, Kota on 20.05.2025 under Section 483 of BNSS. He also submitted that charge-sheet has been filed and disposal of sessions case will take time. 5. Aforesaid contentions were opposed by learned Public Prosecutor. He further submitted that some recovery has been effected during investigation and these petitioners have tried to enter into property of a temple to terrorize and threaten the complainant. 6. Heard learned counsel for the applicants-accused and learned Public Prosecutor. Perused the material placed on record. 7. On the basis of report dated 05.05.2025 lodged by Vinay Goswami Ji Maharaj about unauthorized entry of 8-10 armed persons with Mahendra Puri on 04.05.2025 and intimidation about management and possession of land of temple, FIR No.35/2025 is registered at P.S. Kaithunipole, Kota City. During investigation, police has identified role and involvement of petitioners and other individuals and arrested them. During investigation, police has recovered fire arms from present petitioners Jagveer Singh and Ranjeet Singh. As per police, these petitioner are members of gang of Shivraj Singh, who is kingpin of organized crime, in Kota [2025:RJ-JP:31596] (4 of 4) [CRLMB-7377/2025] region. The police has filed detailed list of 39 members, affiliated to his gang. As per criminal antecedents submitted by police, two criminal cases were registered against Arjun Singh Ranawat. After investigation, police has filed charge- sheet against 10 persons. As per order of trial court, there is no criminal antecedents against Jagveer Singh and Ranjeet Singh but both are not residents of Kota and they were found at Kota on date of incident. There is one criminal antecedents against Bhupendra Singh. Learned Sessions Court has released Mahendra Puri on bail under Section 483 BNSS, who is named in the report and having criminal antecedents. 8. Having considered the totality of facts and circumstances of the case, though there is a dispute pending before the revenue authority but still an attempt is allegedly made to threaten or terrorize complainant, to grab the land of deity, therefore the act of petitioners operating in a gang is of grievous nature and looking to their role and involvement, I am of considered view that this is not a fit case to enlarge petitioners on bail. 9. Accordingly, bail applications preferred by petitioners- Jagveer Singh S/o Shri Samudra Singh, Ranjeet Singh S/o Shri Hargyan, Arjun Singh S/o Shri Durga Singh, and Bhupendra Singh Alias Chotu Banna S/o Shri Raghuraj Singh are hereby dismissed.
