JUSTICE AHANTHEM BIMOL SINGH O R D E R 07-04-2025 Heard Mr. Sh. Athoi Singh, learned counsel appearing for the petitioner and Mr. Shyam Sharma, learned GA appearing for the respondents. At the outset, it has been submitted by both the counsel appearing for the parties that even though there is an alternative statutory remedy of filing an appeal against the impugned order dismissing the petitioner from service, the petitioner has not filed any appeal against the said impugned order. It has further been submitted by the learned counsel appearing for the parties that the present writ petition can be disposed of by giving liberty to the petitioner to approach the appellate authority for filing a statutory appeal within a stipulated period as has been done in earlier cases as in the order passed by this court annexed as Annexure – C/2 and C/3 in the counter affidavit filed by the respondents. In view of the submission made by the learned counsel appearing for the parties, this court is of the considered view that interests of justice will be served by disposing of the present writ petition with the following directions:- IN. 19 SHOUGRAKPAM DEVANANDA SINGH Digitally signed by SHOUGRAKPAM DEVANANDA SINGH Date: 2025.04.07 14:24:04 +05'30' WP(C) No. 882 of 2023 Contd…/- (i) The petitioner is given liberty to file an appeal against the impugned order along with an application for condoning the delay in filing the said appeal, if there is any delay, within a period of six weeks from today; and (ii) It is made clear that the period for which the present writ petition has been pending before this court shall be excluded at the time of computing the period of limitation for filing the statutory appeal. With the aforesaid directions, the present writ petition is disposed of. JUDGE Devananda -2-
