GP FOR FINANCE PLANNING The Court made the following common order: Since the issue involved in all these cases is one and the same, it is deemed appropriate to dispose of the cases by way of a ‘Common Order’. 2. Heard Sri R.K.Acharyulu, learned counsel for the petitioner(s), learned Assistant Government Pleader for Animal Husbandry, learned Assistant Government Pleader for Finance and Planning and Sri Rajesh Kumar Gundapu, learned Standing Counsel for APDCFL appearing for the respondents. 3. The grievance of the petitioner(s) in the present writ petition is against the action of the respondents in not releasing the amounts due to the petitioner(s) towards the supply of milk. 4. Learned counsel for the petitioner(s) contend that the petitioner(s) had been supplying milk to the 4th respondent since 2015 and that the 4th respondent had been making payments towards the milk supplied from time to time. The 4th respondent continued to procure milk from the petitioner(s); however, certain amounts due under the bills raised by the petitioner(s) remain unpaid. Aggrieved by the non-payment of the said amounts, the petitioner(s) have approached this Court by way of instant writ petition. 6 5. Today, when the matter was taken up for consideration, the learned Standing Counsel appearing for the AP Dairy Development Cooperative Federation, the 3rd respondent herein has placed before this Court a copy of the written remarks dated 02.07.2026 received from the 3rd respondent. A perusal of the same reflects that the 4th respondent had run into financial difficulties, resulting in its inability to settle the milk bills payable to dairy farmers. It is stated that, as there are no chances of revival of the 4th respondent, all its regular employees were retired under the Voluntary Retirement Scheme. It is stated that the 4th respondent has no resources to clear the pending dues. The Government was requested for financial assistance. Despite financial assistance extended by the Government through the 3rd respondent herein, the 4th respondent could not recoup from the losses. 6. Therefore, the Government was requested to sanction an amount of Rs.109.00 crores as a one-time grant for clearing the outstanding liabilities. Accordingly, vide G.O.Rt.No.68, dated 23.03.2021, The Government sanctioned an amount of Rs.69.00 crores to the 4th respondent through the 3rd respondent Federation for clearing its liabilities. Out of the said amount, a sum of Rs.17.95 crores was released in March, 2022 to settle the dues of the secured creditors, i.e., Union Bank of India and Punjab National Bank. Thereafter, during July, 2023, the Government released a further sum of Rs.13,29,94,000/- towards clearance of employees' dues, leaving a balance amount of Rs.37,75,06,611/- yet to be released. The said balance amount includes the amounts payable to the petitioners herein. It is further stated that 7 the proposal for release of the remaining amount is under consideration of the Government and upon release of the said amount, the dues payable to the petitioners would be cleared by the 4th respondent. The written remarks 02.07.2026 of the 3rd respondent are taken on record. 7. Having regard to the above, this Court deems it appropriate to dispose of the writ petition(s) with a direction to the respondents to release and pay the amounts due to the petitioner(s) within a period of eight (08) months from the date of receipt of a copy of this order. 8. With the above observation, the Writ Petitions are disposed of. There shall be no order as to costs.
