The petitioner has assailed a Notice dated 03.11.2023 [Annexure- 6] issued by the respondent no. 4 whereby the respondent no. 4 has convened a special meeting at 10 a.m., 10.11.2023 to discuss a motion of no confidence brought against the petitioner as the President, 14th Rangirghat Gaon Panchayat. The petitioner has challenged the said Notice primarily on two counts, firstly, the respondent no.
4 in the capacity of a Circle Officer of a Revenue Circle lacks the authority and jurisdiction to convene a special meeting under Section 15 of the Assam Panchayat Act, 1994; and secondly, as per the direction of this Court in the order dated 14.09.2023, passed in the writ petition, W.P.[C] no. 4285/2023, the petitioner was granted the liberty to grant permission to convene the special meeting till 30.09.2023. By the order dated 10.11.2023, this Court had observed that the outcome of the special meeting scheduled to be held on that day itself, would be subject to the outcome of the writ petition. Page No.# 5/5 Today, when the matter is called, Mr. S. R. Baruah, learned counsel appearing for the respondent nos. 2, 3 and 4 has submitted that during the pendency of this litigation, fresh elections have been held and a new Gram Panchayat Committee has taken over, and therefore, the matter may not require any further adjudication on the issues raised in the writ petition. We find force in the submission made by the learned counsel appearing for the respondents. Therefore, this writ petition is closed with a view that no further adjudication on the issues involved are required in this matter. Mr. Baruah, learned counsel has prayed that if any live cause remains, he may be allowed to file appropriate application to reopen the petition. Prayer so made is allowed.
