1. The present petition has been filed against the order dated 26.6.2021 passed by the Additional Collector, Rajnandgaon Digitally signed by GOPAL SINGH Date: 2025.04.28 11:35:32 +0530
2 who has rejected the petitioner’s claim of compensation under the RBC 6(4). The petitioner’s husband died due to snake bite while he was working in the field. He was taken to the primary health centre where he died during treatment. The doctors did not suggest or ask for post mortem report an the body was sent home with the petitioner and her relatives. The order passed by the above authority is arbitrary and wrong considering the fact that they turned this case of accident that is entitled to compensation as provided by the State Government into natural death.
2. Learned counsel appearing for the petitioner submits that in a similar matter, an appeal, being Writ Appeal No.563 of 2019 (Vikram Bhatt v. State of Chhattisgarh and others) was filed and a Division Bench of this Court decided the said appeal on 9.1.2020 and remitted back the matter to the Court of Naib Tahsildar with a direction to re-open the case.
3. In the instant case, in view of the brief facts available on record, the impugned order dated 26.6.2021 passed by the Additional Collector, Rajnandgaon is set aside. The matter is remitted back to the Court of Naib Tahsildar/Tahsildar, Rajnandgaon for conducting an inquiry and to record evidence of the witnesses who are said to be the eyewitnesses and the witnesses of panchnama. The concerned Naib Tahsildar is
directed that if he, on the basis of the materials available, reaches to a conclusion that husband of the petitioner had died due to snake bite, he shall pass appropriate orders in
3 view of the provisions contained in the Chhattisgarh Revenue Book Circular. It is made clear that this Court has not expressed anything on merits of the case, as such the authorities concerned are at liberty to pass appropriate orders on merits of the case.
4. With the aforesaid observations and directions, the writ petition is disposed of. Sd/-
