The present appeal is directed against impugned judgment of Digitally signed by VIJAY BHARATRAO PEKDE 2 conviction and order of sentence dated 30.08.2014 passed by the Additional Sessions Judge, Dhamtari (C.G.) in Sessions Trial No.16/2013, whereby and whereunder, the appellants stand convicted under Section498-A of IPC and sentenced them to undergo R.I. for 02 years with fine of Rs.200/- - 200/- each, plus default stipulation. 2. Non-bailable warrant issued against the appellants received unserved with a report of S.H.O. Police Station – Magarlod, District Dhamtari (C.G.) that appellant No.1 – Leelaram Sahu, appellant No.2 – Smt. Ram Kunwar Sahu and appellant No.3 – Sonsai Sahu left for heavenly abode on 04.07.2023, 24.08.2022 and 11.12.2022, respectively. The report of the S.H.O. Police Station - Magarlod is duly supported by the death certificates of respective deceased appellants. 3. Learned State counsel has also verified the aforesaid fact and confirmed the death of all the apellants. 4. Thus, in view of the death of all the appellants and in absence of any application for bringing their legal representatives on record to prosecute the appeal, the appeal abates and the same is dismissed as abated. 5.
