THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM:
HON'BLE MR JUSTICE S VISHWAJITH SHETTY ORAL ORDER
1. Accused no.1 in Crime No.15/2025 registered by Agumbe Police Station, Shivamogga District, for the offence punishable under Sections 118(1), 190, 352, 351(3), 109 of BNS, 2023, is before this Court under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.15/2025 was registered by Agumbe Police Station, Shivamogga District, against the petitioner and others based on the first information dated 16.02.2025 received from the injured victim Gopala. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.172/2025 before the jurisdictional Sessions Court, which was dismissed on
07.03.2025. Therefore, he is before this Court. 4. In the first information submitted by the injured victim, he has stated that the petitioner and others who came in search of him at about 9.30 p.m. on 15.02.2025, abused him

using filthy language, and thereafter, assaulted him with a club and also criminally intimidated him before leaving the spot of crime.
He has stated that as a result of the assault, he had lost consciousness and he was shifted to the hospital by his employer and after regaining his consciousness, his statement was recorded by the police. 5. There are serious allegations found against the petitioner in the first information and the petitioner is arrayed as accused no.1 in the FIR. The first informant has made specific allegations of overt act against the petitioner and as a result of the assault made by the accused persons, first informant has suffered multiple fractures on his hand and leg and he was admitted in the hospital for a considerable period of time. Merely for the reason that he is now discharged from the hospital, the same cannot be a ground to entertain the anticipatory bail application of the accused as against whom serious allegations of assaulting a person who has suffered grievous injuries is made. The material on record would go to show that the other accused persons are also not arrested in the present case. Under the circumstances, I am of the opinion

that petitioner's prayer for grant of anticipatory bail cannot be entertained. Accordingly, petition is dismissed. Sd/- (S VISHWAJITH SHETTY) JUDGE
