This anticipatory bail application under Sections 482 & 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest for offences under Sections 333/109(1)/115(2)/118(1)/352/351(3)/ 3(5) of B.N.S., 2023. 3. The allegation in the F.I.R. is that the informant alleged that on 18.06.2025 her mother was at her home. At that time his neighbors, Dharmendra Kumar Sah, Pinki Devi & Naval Kishor armed with lathi, danda and rod in their hands, came there and started abusing her. Accused Dharmendra Sah assaulted her old mother with iron rod with intention to kill her. She sustained injury on her both hands. When informant’s brother went to rescue her, they also assaulted him and while they were fleeing, they stated that if they file any case against them, then they will eliminate the whole family of the informant. 4. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 5. After hearing the parties, I find that one of them is a lady and another is an old person aged about 72 years and there is no allegation against them of causing any assault. 6. Considering the aforesaid facts, I am inclined to allow this application. 2025:JHHC:21323 2 7. Accordingly, this Anticipatory Bail Application stands allowed. The petitioners, above named, are directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of their surrender or arrest, they shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Godda, in connection with Thakurgangti P.S. Case No.21/2025, subject to the condition that one of the bailers should be a close relative of the petitioners and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, they have to file an affidavit before the Trial Court indicating his/her share in the property.
