This is an application wherein petitioner has prayed for expeditious disposal of the Criminal Proceeding being Case No. C- 537C/2008 presently pending before learned Judicial Magistrate, Kalyani. It is submitted on behalf of the petitioner, who appeared in person that a proceeding was initiated in the year 2008 and for more than 17 years the case is going on and the trial court has not yet concluded the trial, accordingly, he prayed for a direction upon the court below for expeditious disposal of the said proceeding. Having heard petitioner, who appeared in person, it appears that the prayer made by the petitioner is innocuous and, if any, order is passed in terms of the prayer made in the petition, the opposite parties will have no cause to prejudice and as such, service of copy of application upon the opposite parties is dispensed with. It is further submitted on behalf of the petitioner that only two witnesses are required to be examined and next date is fixed on 2nd March, 2026. Having heard petitioner, it appears, that the prayer made on his behalf is justified in view of the long pendency of the case and as such it is required to be allowed for the ends of justice. 2 CRR 4052 of 2025 is hereby disposed of with a direction upon the court below to conclude recording of evidence preferably within a period of two months from the next date of hearing and thereafter following next procedure he will deliver judgment preferably within a period of two months thereafter.
