05/11.06.2025: This is an application filed by the petitioner praying for grant of anticipatory bail in terms of sections 482 and 484 of Bharatiya Nagrik Suraksha Sanhita, 2023, as the petitioner has been allegedly implicated in connection with Sarwan PS Case No. 49 of 2024, for the offences punishable under sections 363, 366, 376 and 34 of the Indian Penal Code and section 4/6 of the POCSO Act, pending in the court of learned Additional Sessions Judge- III-cum- Special Judge, POCSO, Deoghar. 2. Heard the learned counsel for the petitioner and the learned counsel for the State. 3. The learned counsel for the State has opposed the prayer for anticipatory bail of the petitioner. 4. An FIR has been lodged at the instance of the father of the victim girl. It is stated that victim was aged about 17 and 1/2 years at the time of incident has been kidnapped by this petitioner and Santosh Verma. 5. On the last date statement of the victim under section 164 Cr.P.C. was called for by this Court which has been produced before this Court today in a sealed cover. 6. I have gone through the statement of the victim under section 164 Cr.P.C wherein she has stated that she is 17 years old and her age was also assessed by the Court as 17 years. She has stated that Santosh Verma (co-accused) came in touch with her and on 03.6.2024 he called the victim and offered that he will marry her. The victim further stated that she did not agree to that then Santosh Verma called her again as he was waiting outside. The Victim met Santosh

It was thereafter alleged that Santosh Verma and this petitioner made her sit in a car and took her to the house of the sister of Santosh Verma wherein brother-in-law of Santosh Verma brought vermilion and Santosh Verma put the same on her head. Thereafter this petitioner and brother-in-law of Santosh Verma left.
She further stated that thereafter Santosh Verma forcefully established physical relationship with her. 6. Considering the statement of the victim under section 164 Cr.P.C. I find that there is no allegation of any assault or sexual assault by this petitioner. Entire allegation is against Santosh Verma. Thus, I am inclined to release the petitioner on anticipatory bail. 7. Accordingly, the petitioner, above named, is directed to surrender before the court below within three weeks from today and in the event of his surrender/arrest the learned court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge- III-cum- Special Judge, POCSO, Deoghar, in connection with Sarwan PS Case No. 49 of 2024, subject to the condition that one of the bailers should be close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/ her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the learned trial court indicating his /her share in the property.
