Opp. Party --------- CORAM: HON'BLE MR. JUSTICE RAJESH KUMAR --------- For the Petitioner : Mr. Rahul Pandey, Advocate For the NCB : Mr. Anil Kumar, A.S.G.I --------- 03/Dated: 29 th August, 2025 1. Heard learned counsel for the applicant and learned counsel for the N.C.B. 2. The applicant, who is in custody since 09.06.2023, has renewed the prayer for grant of regular bail in connection with NDPS Case No.36 of 2023, arising out of NCB Crime No.02/NCB/Ranchi/2023. 3. It appears that this applicant has been made an accused for committing the offence under Sections 20(b)(ii)(C), 25 & 29 of the NDPS Act. The prayer for bail of this applicant was lastly rejected vide order dated 19.03.2025, passed in B.A. No.1317 of 2025 reserving liberty with the petitioner to renew his prayer for bail if the trial is not concluded within three months. It is the third attempt. 4. Innocence of the applicant has been claimed and undertaking has been given for participation in the trial. 5. Having heard learned counsel for the parties and from perusal of the report, which has been called for from the trial court, it appears that out of eight charge-sheeted witnesses, six have already been examined. Thus, from the last rejection order, only one witness has been examined till date. The applicant has remained in custody for more than two years. He was present in the truck in the capacity of cleaner of the alleged truck, as per the prosecution. 6. Considering the fact that the petitioner has remained in custody for more than two years, I am inclined to enlarge the applicant on bail. Accordingly, the applicant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judicial Commissioner – X - 1 - B.A. No.7207 of 2025 2025:JHHC:26026 -cum- Special Judge -NDPS, Ranchi, in connection with NDPS Case No.36 of 2023, arising out of NCB Crime No.02/NCB/Ranchi/2023, on the condition that this applicant will submit self-attested photocopy of his Aadhaar Card and his mobile number before the learned trial court which he will always keep active and will not change it during pendency of this case without prior permission of the court.
