This matter is taken up through hybrid mode. 2. Petitioner, in this writ petition, prays for the following relief; “It is therefore, humbly prayed that your Lordship's may graciously be pleased to allow this writ application, issue rule of NISI calling upon the Opp. parties to show cause, and after hearing the parties, direct the Opp. Parties more particularly the Opp. Party No.2 to consider the application filed by the petitioner under Annexure-7 series within such stipulated period of time as may be directed by this Hon'ble Court.” 3. Mr. Mishra, learned counsel for the Petitioner submits that for acquisition of land by NALCO, the elder brother of the Petitioner, namely, Shyamsundar Dalai was given appointment in terms of the policy under Annexure-1 floated by NALCO. 4. The Petitioner being the younger brother of the beneficiary had only received the share of compensation for acquisition of land, but he was not extended with any benefit under the policy of Annexure-1. It is his submission that neither any consent nor any information was given to the Petitioner while nominating his brother, namely, Shyamsundar Dalai to get appointment under the rehabilitation policy. 5. The Petitioner has also submitted a representation to the Authorities of NALCO for rehabilitation appointment which is not being considered. Mr. Mishra, learned counsel, however, drew attention to the communication dated 15th September, 2022 (Annexure-4) by the Senior Manager (HRD NALCO), Damanjodi, which indicates that since the elder brother of the Petitioner, namely, Shyamsundar Dalai being nominated has been given appointment under the policy, the case of the Petitioner cannot be considered. 6. After arguing for some time Mr. Mishra, learned counsel for the Petitioner prays for withdrawal of the writ petition to workout the remedy with the Authority, if any, available. 7.
