For the Opp. Party : A.P.P ------- 02/30.03.2026 Heard Mr. Bhola Nath Rajak, learned counsel for the petitioner and learned A.P.P. The petitioner is an accused in connection with Nimdih P.S. Case No.45 of 2025. It has been alleged that the petitioner had tried to commit rape upon the informant and when the informant raised a cry of alarm, the brother of the informant arrived at which the petitioner had fled away. It has been submitted by the learned counsel for the petitioner that on completion of investigation, charge sheet has been submitted. Learned counsel adds that the petitioner is in custody since 16.09.2025. it has further been submitted while referring to the statement of the villagers recorded at paragraph-109 of the case diary that the house of the petitioner was adjacent to the informant and the informant is aged about 47 years who is a widow and stays with her child and therefore relationship between the petitioner and the informant cannot be ruled out. Learned A.P.P has opposed the prayer for bail of the petitioner. Regard being had to the statements of the witnesses and the overall conspectus of the case apart from the period of custody undergone by the petitioner, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-III, at Seraikella in connection with Nimdih P.S.
