Judgment on Board Per Ramesh Sinha, Chief Justice 10/06/2025
1. The instant appeal has been preferred by the State government against the order dated 25.04.2022 passed by the learned single judge in WPS No. 2824 of 2022 (Doman Lal Chandrakar and Ors. Vs. State of C.G. and Ors.) by which the learned Single judge
disposed off the writ petition directing the respondent No.1 (State) to take an appropriate decision as a policy matter so far as the implementation of the judgment of the Hon'ble Supreme Court as regards enhancement of the duty allowance payable to the Home Guards are concerned. The learned Single Judge further directed that an appropriate decision be taken ensuring the compliance of the judgment of the Hon'ble Supreme Court in its letter and spirit at the earliest preferably within a period of 4 months from the date
3 of receipt of the copy of this order.

At the very outset, learned State counsel submits that a review petition (Civil) Diary No (s) 20061/ 2023 has been filled by the Union Of India before the Apex court for review of the order passed in CA No. 2768 of 2015, and other connected matters including CA No. 2759 of 2015 arising out of SLP (C ) No. 12858 of 2009 dated 11.03.2015 which is stated to be pending.

At this juncture, learned counsel for the respondents, Mr. Pali submits that the respondents have also preferred a contempt petition bearing No. 1036 of 2022 before this court in which it is stated that the review petition preferred by the Union Of India has been dismissed on 25.07.2024 and copy of the order has also been filed in the contempt petition.
4. We have heard learned counsel for the parties.
5. In view of the submission made by learned counsel for the respondents that the order of the Supreme court passed in CA No. 2768 of 2015 has again been affirmed in the review petition filed by the Union of India, the present writ appeal is also dismissed. Sd/- Sd/-
