JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in C.C.No.10537/2021 pending before the Court of Principal Civil Judge & JMFC, Devanahalli, Bangalore Rural District, arising out of Crime No.25/2019 registered by the Bagalur Police Station, Bangalore Rural District, for the offences punishable under Sections 114, 143, 147, 148, 452, 427, 307, 324, 504, 506 read with Section 149 of IPC, is before this Court under Section 439 of Cr.P.C., seeking regular bail. 2. Perusal of the material on record would go to show that the petitioner who was arrested in the present case on 20.03.2019, was granted statutory bail and was released from custody. After filing of the charge sheet, the petitioner had not appeared before the Committal Court. Therefore, coercive steps were taken against him and a split-up case in C.C.No.10537/2021 was registered against him. In the split-up case, petitioner's presence was secured by the Committal Court on 16.12.2024 and on the said date, he was remanded to judicial custody. His bail application filed thereafter before the - 3 - HC-KAR NC: 2025:KHC:24933 CRL.P No. 4170 of 2025 trial Court in Crl.Misc.No.15015/2025, was rejected on 21.01.2025. Therefore, he is before this Court. 3. Learned High Court Government Pleader has brought to the notice of this Court that the petitioner is a person with criminal antecedents and he is totally involved in 67 criminal cases registered against him by various police stations, in and around Bengaluru. He has furnished the list of criminal cases registered against the petitioner and submits that in 59 criminal cases registered against him, non-bailable warrants issued against him are pending and in some of the cases, even proclamation orders are issued against the petitioner. In some of the criminal cases registered against the petitioner, body warrants have been obtained and petitioner is required to be produced under body warrant in the said cases. He further submitted that in the event the petitioner is enlarged on bail, it would be difficult to secure his presence. 4. Perusal of the material on record would go to show that after the petitioner was earlier enlarged on bail in the present case, he has involved himself in other criminal cases. Therefore, the chances of petitioner committing similar offences - 4 - HC-KAR NC: 2025:KHC:24933 CRL.P No. 4170 of 2025 in the event he is enlarged on regular bail cannot be ruled out. Under these circumstances, I am of the opinion that this is not a fit case for granting regular bail at this stage. Accordingly, petition is dismissed.
