Case No. 01(A)/2023(D), registered for the offences under Sections 120-B read with Sections 409 and 420 of the Indian Penal Code and Section 13(2) read with Sections 13(1)(a) of the Prevention of Corruption Act, pending in the court of learned Special Judge, CBI-cum-Additional Sessions Judge-1st, Dhanbad. 2. Mr. A.K. Kashyap, learned senior counsel appearing for the petitioner submits that Manoj Kumar is the Branch Manager of the Bank, against whom, main allegation is made and the petitioner is the step-son of Manoj Kumar, however, the allegations are made that certain amount has been transferred in the account of the petitioner. He submits that the name of the petitioner has not come in the first charge-sheet, however, in the supplementary charge-sheet, the name of the petitioner has appeared. He submits that in identical situation, co-accused has been granted anticipatory bail by this Court in A.B.A. No.1979 of 2025. 3. Mr. Deepak Kumar Bharti, learned counsel appearing for the CBI has opposed the prayer and submits that the petitioner in connivance with the Branch Manager, have mis-utilized the amount of the retired persons. He ( 2025:JHHC:25782 ) -2- A.B.A. No. 4820 of 2025 further submits that sum of Rs.14 Lakhs has been transferred in the account of the petitioner and in view of that, the prayer for anticipatory bail may kindly be rejected. 4. Considering that now the chargesheet has already been submitted and the petitioner was not arrested by the CBI in course of investigation and in view of that, it transpires that the petitioner has co-operated in the investigation and further in the first chargesheet, the petitioner was not named and subsequently, in the supplementary chargesheet, the petitioner has been made accused and in the attending facts and circumstances of the case, I am inclined to provide privilege of anticipatory bail to the petitioner. 5. Accordingly, the petitioner, named above, is hereby directed to surrender before the learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Special Judge, CBI-cum-Additional Sessions Judge-1st, Dhanbad in connection with R.C. Case No.- 01(A)/2023(D), subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Ajay/
