1. In spite of valid service of notice, nobody appears on behalf of the opposite party/husband.
2. The present transfer petition has been filed under Section 24 of the Code of Civil Procedure for transfer of Original Suit No.153 of 2024 from the Court of learned Principal Judge, Family Court, Bokaro to the Court of learned Principal Judge, Family Court, Lohardaga.
3. It appears that they got married in the year 2019. It further appears that the original suit has been filed by the husband under Section 13 (i) (1-a) of the Hindu Marriage Act, 1955 for dissolution of marriage. One of the opposite party i.e. opposite party No.2 has not appeared in the court below also and from the office report, it appears that the residential address has been given wrong. It is the address given by the husband who has instituted the suit. He has chosen not to participate in the present proceeding.
4. It further appears that there is no proper communication between Bokaro to Lohardaga. The wife is non-earning person.
5. Considering the peculiar facts and circumstances of this case and the fact that wrong address has been given in the suit itself, I am inclined to allow the present petition. Accordingly, the Original Suit No.153 of 2024, is hereby, transferred to the Court of learned Principal Judge, Family Court, Lohardaga.
6. The present transfer petition stands disposed of.
