Also heard Mr. DP Goswami, the learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 482 of the BNSS, 2023, praying for grant of pre- arrest bail in respect of Barpeta P.S. Case No. 391/2024. Page No.# 2/2 3. On 12.10.2024, at midnight, one vehicle bearing registration No. AS-15-AC/0327 was moving around the town in a suspicious manner. Police gave signal to the driver to stop the vehicle, but the vehicle ran away. Police chased the vehicle and arrested three persons, namely, Sanidul Ali, Tajel Sikdar and Sanidul Islam. Police also recovered many articles from the vehicle, which were normally used by thieves and dacoits for cutting metal, doors etc. According to police, the present petitioner Kamal Uddin and some other persons were also present in the vehicle but others somehow managed to escape. 4. I have considered the submissions made by the learned counsels of both sides. 5. From a perusal of the case diary, it appears that there are sufficient incriminating materials against the petitioner Kamal Uddin. Therefore, he is not entitled to the privilege of anticipatory bail. 6. Therefore, the prayer for bail is rejected. The CD shall be returned. JUDGE Comparing Assistant
