A case has been registered against the petitioner and others for the offence punishable under Section 20(b)(ii)(C) r/w 25, 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Case of the prosecution, in brief, is that, on 24.02.2025 at 08.00 hours, on receiving-credible information regarding illegal transportation of ganja, Sub-Inspector of Pol-Ice, Pedabayalu Police Station, along with his staff and mediators, proceeded to Kothaput -Junction, Adugulaput Panchayath, Pedabayalu Mandal, AIluri Sitharama Raju district and while conducting vehicle checking` found auto bearing No.AP31 TF 2137 loaded with 100 Kgs of ganja driven by Accused No.1. The accused No.1 was arrested and got remanded to judicial custody` on the even date and the contraband, along with the vehicle, was seized under the,cover of med-lators report. 4. Learned counsel for the petitioner submits that the petitioner was remanded to judicial custody on 24.02.2025 and since then he is .-_-_.--.--1' languishing in jail. He further submits that petitioner is an Auto driver and he also owner of the Auto. He has nothi'ng to do with the ganja which is been transported by the co-accusedl 5. Learned Assistant public Prosecutor submits that major portion of the investigation has been completed except filing of formal charge sheet- 6. Heard. Perused the record. 7. A perusal of the material on record goes to showthat 100 Kgs of ganja was allegedly seized from- the possession of petitionerp The Petitioner Was arrested and remanded to J-udiCial Custody On 24.02.2025 and since then he is languishing in jail. Since it is submitted by the learned Assistant Public Prosecutor that major POrtiOn Of investigation has been completed except filing Of formal charge sheet, this Court is inclined to release the petitioner on bail. 8. Accordingly, the criminal petition is allowed.
