1. Heard learned counsel for the petitioner and learned A.P.P. for the State Mr. Chandra Bhushan Prasad. 2. The petitioner seeks bail in connection with Sugauli P.S. Case No.530/2023, registered for the offences punishable under Sections 302, 201, 120(B) and 34 of the Indian Penal Code. 3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant who is mother of the deceased alleges that the marriage of her daughter was performed with the petitioner about 8 years back and out of the wedlock, four children were born. It is further alleged that once the petitioner saw her daughter talking to a person and thus started harbouring suspicion that she was

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that the marriage was 8 years old and in between these 8 years, no case ever came to be instituted either by the informant or the deceased alleging any kind of torture by the petitioner. It is also submitted that out of the wedlock, four children were born, who are presently staying with the petitioner. It is also submitted that petitioner is in custody since 20.07.2025. 5. Learned A.P.P. Mr. Chandra Bhushan Prasad opposes the regular bail application of the petitioner and submits that what is not disputed rather stands admitted is that daughter of the informant died. It is also submitted that after killing the deceased, her dead body was cremated, as such postmortem could not be held.
It is further submitted that had the petitioner not been involved in the occurrence, in that event, he would have informed the informant and other family members regarding the death of the victim but then same was not done rather the dead body was cremated. 6. Considering the submissions made by the learned
