Phookan, learned counsel for the petitioner. Also heard Mr. K. Kalita, learned Standing Counsel, Oil. The learned counsel for the respective parties have placed before the Court the written declarations received from their respective arbitrators under Section 12 of the Arbitration and Conciliation Act, 1996. Justice Krishna Murari, Former Judge of the Hon’ble Supreme Court of India has issued a written declaration dated 09.06.2025 expressing no difficulty, hardship or handicap for acting as an arbitrator on behalf of the petitioner and Justice J. R. Midha, Former Judge of Delhi High Court has also expressed no difficulty, hardship or handicap for acting as an Arbitrator on behalf of the respondents. Page No.# 3/3 In that view of the matter Justice Krishna Murari, Former Judge of the Hon’ble Supreme Court of India is appointed as an Arbitrator for the petitioner and Justice J.R. Midha, Former Judge of Delhi High Court is appointed as an Arbitrator for the respondents. The parties will now appear before the learned Arbitrators and the learned Arbitrators with endeavor will appoint the Presiding Arbitrator. In terms of the above order the arbitration petition stands closed and the copies of the written declarations furnished by Justice Krishna Murari, Former Judge of Hon’ble Supreme Court of India and Justice J.R. Midha, Former Judge of Delhi High Court are kept as a part of the case record. The parties will appear before the Tribunal comprising of the learned Arbitrators Justice Krishna Murari and Justice J.R. Midha within four(04) weeks from the date of receipt of certified copy of this order. Let this order be communicated to Justice Krishna Murari, Former Judge of Hon’ble Supreme Court of India and Justice J.R. Midha, Former Judge of Delhi High Court by the Registry.
