JUSTICE SANDEEP KUMAR ORAL ORDER 3 09-05-2025 Heard the learned counsel for the petitioner and learned APP for the State. 2. The petitioner seeks regular bail in connection with Kesariya P.S. Case No. 220 of 2024 registered for the offence under Sections 366(A), 34 of the Indian Penal Code. 3. As per the prosecution case, the petitioner is accused of kidnapping the minor daughter of the informant. 4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 23.07.2024. 5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail. 6. From the statement of the victim girl recorded under Section 183 BNSS, it appears that she had left her home Patna High Court CR. MISC. No.13873 of 2025(3) dt.09-05-2025 2/2 on her own because she was having an affair with the petitioner. 7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed. 8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, East Champaran at Motihari/concerned Court below in connection with Kesariya P.S.
