Pitchaiah – W.P. No.7659 of 2025 Advocate(s) for Respondent(s): Mr. Kambhampati Ramesh Babu, SC for AP Information Commission
CORAM : THE CHIEF JUSTICE LISA GILL SRI JUSTICE CHALLA GUNARANJAN DATE : 1st July 2026 LISA GILL, CJ: W.P(PIL) No.21 of 2025, W.P. No.24451 of 2024 and W.P. No.7659 of 2025 are taken up together for hearing and adjudication at request and consent of learned counsel for parties, as all of them arise from administrative orders as are described therein.
2. W.P. (PIL) No.21 of 2025 has been filed in public interest seeking a direction to respondent Nos.6 to 9 therein to comply with following administrative orders:

3. W.P. Nos.24451 of 2024 and 7659 of 2025 have been filed by State Information Commissioners aggrieved of withholding of their salaries and allowances on account of non-submission of biometric attendance.
4. Salary of petitioner in W.P. No.24451 of 2024, it is stated, was withheld for the month of September, 2024 and qua petitioner in W.P. No.7659 of 2025, it was withheld for the months of September and October, 2024.
5. It is the case of petitioners in W.P. Nos.24451 of 2024 and 7659 of 2025 that administrative orders in question insisting on biometric attendance and withholding of salary are absolutely illegal and arbitrary inasmuch as both the said petitioners had duly attended to their matters on the said working days and had disposed of a number of cases, details of which are mentioned in their respective writ petitions.
6.
Learned counsel for respondent Andhra Pradesh Information Commission submits that all the petitions are rendered infructuous in view of
order dated 10.02.2026, issued by State Chief Information Commissioner whereby administrative orders mentioned above as well as some others have been withdrawn. It is specifically stated in said order, dated 10.02.2026, that orders which were in force prior to 16.11.2022, shall come into force with immediate effect and that strict compliance thereof be maintained. Aforesaid proceedings, dated 10.02.2026 are taken on record subject to just exceptions.
3 HCJ & CGR, J W.P(PIL). No:21 of 2025 & batch
7.
Learned counsel for Andhra Pradesh Information Commission submits that insofar as W.P. Nos.24451 of 2024 and 7659 of 2025 are concerned, he has specific instructions to state that petitioners therein had in fact attended to their work on dates specified in writ petitions and only reason for withholding their salary was due to non-submission of biometric attendance.
8. It is further submitted that said petitioners had indeed disposed of matters on said working days, therefore, necessary action for release of their salaries shall be taken within next 15 days.
9. Keeping in view the aforesaid stand of respondent – Commission, it is apparent that present writ petitions are indeed rendered infructuous. Ordered accordingly. It is directed that necessary action for release of salaries of petitioners in W.P. Nos.24451 of 2024 and 7659 of 2025 be taken in terms of statement made before us. No costs.
Pending miscellaneous applications, if any, shall stand closed.
