This anticipatory bail application under Section 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita 2023, has been preferred by the petitioners apprehending their arrest for offences under Section 303(2), 317(5), 3(5) Bharatiya Nyaya Sanhita and Section 4 MMDR, Act and Rule 7, 9, 13, Jharkhand Minerals Prevention of Illegal Mining, Transportation & Storage Rule & Rule 4/54 JMMC Rule, in connection with Dhanwar (Ghodthambha O.P.) P.S. Case No. 149 of 2024, pending in the Court of learned Judicial Magistrate 1st Class, Giridih. 3. There is an allegation that this petitioner was involved in illegal mining of mica. 4. Learned counsel for the petitioner submits that he has no concern either with the truck or with the mica which has been illegally mined and his name transpired from the confessional statement of the co-accused. 2025:JHHC:21200 2 5. Learned A.P.P. for the State opposes and submits that thrice notices under Section 35 (3), BNSS was issued to the petitioners and in spite of receipt of the notice, they have not cooperated with the investigation and have not appeared before the I.O. 6.
