Neutral Citation No. - 2025:AHC:42436 Court No. - 6 Case :- WRIT - A No. - 2487 of 2025 Petitioner :- Smt. Najma Respondent :- State of U.P. and Another Counsel for Petitioner :- Aamir Nizam,Shabana Nizam Counsel for Respondent :- C.S.C.,Irshad Ahmad,S.K. Srivastava Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Sri Amir Nizam, learned counsel for the petitioner and Sri S.K.Srivastava for the respondent no.2.
2. Not only the petitioner was sleeping over her right, but this Writ Petition is bereft of necessary pleadings in support of prayer to grant family pension.
3. It is not under dispute that petitioner’s husband has served about six years in the office of respondent no.2 and died on 30.5.1998 i.e. about more than 27 years ago and not only she was paid her retiral dues, but her son was also given compassionate appointment and now after such a long period, petitioner is claiming that she is entitled for family pension.
4. When the learned counsel for the petitioner was confronted to provide legal provision under which such prayer could be allowed, however, not only the writ petition, but counsel for petitioner is also silent on this issue, This is nothing but just a waste of crucial time of this Court.
5. This Court was inclined to impose cost on the learned counsel for the petitioner, however considering that learned counsel for the petitioner will remain cautious in future while filing writ petition, therefore, in the interest of justice this Court is not imposing any
cost.
6. With aforesaid observation, this Writ Petition is dismissed. Order Date :- 24.3.2025 SB Digitally signed by :- SANDEEP BHATTACHARYA High Court of Judicature at Allahabad
