O R D E R The fourth respondent had borrowed a sum of ?3,00,000/- from the petitioner. The petitioner alleges that the said amount has not been repaid till date. On the basis that three plots were allotted to the fourth respondent wrongly, the petitioner had made a representation in relation thereto. By this Writ Petition, the petitioner seeks an inquiry in relation thereto. 2. Learned Government Advocate accepts notice for respondents 1 to 3. He has placed on record documents showing that natham patta was issued in the name of Kaliammal, wife of Manoharan, in respect of Natham Survey No.135/9 and that natham patta was issued in the name of Kaliammal, wife of Kulandhavelu, in respect of Natham Survey No. 135/84. Similarly, he points out that the natham patta was issued to Kalimammal, wife of Sundarraj, in respect of Natham Survey No.135/87. 2/5 https://www.mhc.tn.gov.in/judis
W.P(MD)No. 29858 of 2025 Therefore, he submits that there was no infirmity in the issuance of pattas to these three persons. 3. As a lender, if the loan is not repaid, it is open to the petitioner to initiate appropriate legal proceedings to recover money due to the petitioner. Instead, the petitioner has attempted to harass the fourth respondent by raising a complaint that the fourth respondent had received natham pattas in relation to three plots. I find no merit in the request of the petitioner and no reason to exercise discretionary jurisdiction in favour of the petitioner. 4. For reasons stated above, this Writ Petition is dismissed without any order as to costs.
