THIS WP IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO QUASH THE NOTICE DATED 06.01.2025 VIDE ANNX-A PASSED BY THE TAHSILDAR R-4 IN NO.TAH/MYS/LND/192A/CR-02/2024 WHEREIN THE TAHSILDAR HAS MENTIONED THAT, THE DARKASTH ORDER MADE IN FAVOUR OF THE ORIGINAL GRANTEE SRI SHANKAR PRASAD WAS CANCELLED AND THEREFORE, WHY KHATA CANNOT BE CANCELLED AS PROVIDED UNDER RULE 25 OF KARNATAKA LAND REVENUE RULES 1969, ETC.

ORAL ORDER
1. The petitioners are challenging a show-cause notice by which they have been called upon to furnish an explanation to the contents of the notice.

2. The notice indicates that a grant made vide GDR No.33/45 was cancelled by Huzoor Sub-Divisional Saheb in GDR No.125/1949-50 and there was also an entry made to that effect in the record of rights. The Thasildar, therefore, basically doubts the entitlement of the petitioners in the land in question.

Learned counsel for the petitioners submits that the petitioners would be ill-equipped to furnish a reply in the absence of the documents, which are referred to in the Thasildar's notice furnished to them.
4. In my view, in the light of this submission, it would be appropriate to direct the Thasildar to furnish the documents relating to the alleged cancellation made by the Huzoor Sub-Divisional Saheb in GDR No.125/1949-50 to enable the petitioners to file objections on the said order being furnished to the petitioners. The petitioners are granted two weeks' time on the documents being furnished to them to file objections and the Thasildar shall thereafter

consider the objections and pass orders in accordance with law.
5. In view of the disposal of the petition, all pending interlocutory applications, if any, stand disposed of.
