2. The petitioner is apprehending his arrest in connection with Complaint Case No.5855 of 2023, registered for offences under section 498-A, 417 and 120B IPC and Sections 3 and 4 of Dowry Prohibition Act, pending in the court of learned Judicial Magistrate XIII, Ranchi..

Learned counsel for the petitioner submits that the petitioner happened to be husband of the complainant and after filing of the complaint she has filed the maintenance case in which compromise has been reached between the parties and to buttress his such argument he refers to the mediation report contained in Annexure-2 and by way of referring the same, he submits that complainant was supposed to withdraw the present case however she has not withdrawn as yet.

Learned counsel for State submits that the case is arising out of complaint case and he is not disputing the Annexure-2.

In view of the above, and considering annexure-2 which is mediation report, and further the petitioner is husband and in view of that, the petitioner is directed to surrender before the learned court within two weeks from today and the learned court shall release the petitioner above named on such terms and conditions as well as sureties as the learned court may deem fit and proper.
6. This petition is accordingly disposed of.
