p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) No.20776 of 2025 Abhimanyu Parida …. Petitioner(s) Mr. P. K. Maharaj, Advocate -versus- Collector-cum-District Magistrate, Nayagarh and others …. Opp. Party(s) Mr. Debraj Mohanty, AGA CORAM: JUSTICE SIBO SANKAR MISHRA Order No. ORDER 16.04.2026 01. 1. Heard. 2. In the present petition, the petitioner is seeking a direction for compliance of the order dated 06.04.2023 passed by the Collector-cum-District Magistrate, Nayagarh-opposite party No.1 in Arbitration Appeal Case No.11 of 2023, whereby the compensation awarded to the petitioner has been enhanced to Rs.88,000/- per decimal, as has been paid to the owner of Plot No.991 excluding the amount already received. 3. Since the order sought to be complied by the petitioner is arising out of an arbitration proceeding, prima facie, the writ petition is not maintainable for the purpose of execution of such order. 4. At this stage, Mr. Maharaj, learned counsel for the petitioner seeks to withdraw the present petition p. 2 with liberty to resort to the appropriate remedy provided under law. 5. Needless to say that, the nature of dispute involved in the present case needs urgent redressal. Therefore, if the petitioner resorts to the remedy available to him under law, it is expected that the authority concerned shall do well to see that the proceeding is disposed of as expeditiously as possible. 6. With this observation, the writ petition is disposed of. (S.S. Mishra) Judge Swarna
