MANJARI NEHRU KAUL, J. (ORAL) The petitioner is seeking the concession of anticipatory bail under Section 482 of BNSS, 2023, in FIR No.
318, 336, 338, 340, 61(2) of BNS, 2023, City Moga, District Moga. On the last date of hearing i.e. following submissions made by the learned counsel for the petitioner, coordinate Bench of this Court had granted the concession of interim bail to the petitioner and asked her to join investigation:

that all the claimants to the estate of Ram Singh accepted the registered Will dated 09.09.2016 (Annexure P-2). The petitioner has sold the property in question to the extent of her own share vide registered sale deed to different persons. It is further submitted that petitioner has not committed any cheating or forgery as alleged by the complainant in the FIR and prima facie, no offence is made out. Counsel for the petitioner further submits that petitioner who is having no criminal history is ready and willing to join investigation with the police.”

Learned counsel for the petitioner submits that in compliance of order dated 04.02.2025, petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions from Inspector Gurpreet Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for her custodial interrogation.

In view of the above, the petition is allowed and interim order dated 04.02.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
