For the Informant : Mr. Ritesh Kumar, Advocate -------- 02/ Dated 19.08.2025 Heard the parties. Both these two bail applications arise out of the same police case and as such, these bail applications are being disposed of by this common order. The petitioners have been made accused in connection with Raidih P.S. Case No. 16 of 2025, for the offence under Sections 103(1)/3(5) of the B.N.S., 2023, pending in the court of learned Judicial Magistrate, 1st class, Gumla. On 18.02.2025 at about 7:00 a.m., 4 to 5 persons committed the murder of the husband of the informant namely Prasad Sahu. The neck of the deceased was slit open. Suspicion has been raised against one Laldhan Lohra that due to previous enmity, he might have committed the murder of the deceased. Mr. Mohit Prakash, learned counsel for the petitioner Mohan Mahli in B.A. No. 7075/2025 submitted that petitioner was put on T.I. parade after three months from his arrest and the daughter of the informant has identified him as a person who was present at the place of occurrence with a gun. Learned counsel appearing for the petitioner Santoshi Nag in B.A. No.3393/2025 submitted that apart from confession, there is no other material against the petitioner on record. Learned A.P.Ps on behalf of the State, assisted by Mr. Ritesh Kumar, learned counsel appearing on behalf of the informant have vehemently opposed the prayer for bail and submitted that the daughter of the informant has identified Laldhan Lohra as a person who was present at the place of occurrence with a knife. -2- Considering the fact that T. I. Parade of the petitioner Mohan Mahli was conducted after three months from the date of his arrest and the fact that petitioner Santoshi Nag has not been identified in T.I. Parade, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st class, Gumla, in connection with Raidih P.S.
