Petitioner is aggrieved by the fact that in spite of informing the police authorities, no steps have been taken. Petitioner accuses the private respondents of interfering with his part of the property and encroaching the same. State has submitted a report. Report reflects that proceedings are pending before the WBLRTT and the matter has been fixed on 7th July, 2025 for final hearing. Learned advocate for the private respondents denies and disputes the contention and submits that there has been no violation or infraction of law 2 passed by any authorities at the behest of the private respondents. Having regard to the fact that the petitioner and the private respondents are contesting at least before the WBLRTT and as the police authorities have already drawn up proceedings under Section 126 of the BNSS, they would keep a surveillance so that there is no untoward incident resulting because of the strained relationship existing between the parties. With the aforesaid observations, WPA 9441 of 2025 is disposed of. There will be no order as to costs. Report so submitted be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
