ORDER: Heard the submissions of the learned counsel for the petitioner and Smt. Sudeepthi Potiuri, learned Assistant Government Pleader for Mines and Geology for the respondents. The grievance of the petitioner is that pursuant to the show cause notice, dated 09.02.2024, the petitioner has submitted his explanation, dated 04.03.2024. Pursuant to the application filed by the

2 p6titioner for grant of quarry lease of building stone, manufacturing sand, road metal etc., in respect of the subject land, the Technical Staff of the Mining Department has inspected the land and found that there are two pits that were existing in the subject land. Thus show cause notice, dated 09.02.2024 was issued to the petitioner to show cause within 15 days as to why action should not be taken against the petitioner and as to how what had happened to the mineral extraction that was made and unauthorized transportation of the same. It is stated that the petitioner has submitted his explanation, dated 04.03.2024.

Learned counsel for the petitioner submits that the petitioner has submitted his explanation however, the same was not considered while passing the impugned
order, though reference was made to the said explanation, while passing the impugned order. Considered the rival submissions. A perusal of the impugned
order would show that no reasons as such are given by the respondent No.3, while passing the order. The respondent No.3 did not assign any reason for its conclusions as to on what basis the quantity and quality of the mineral that has been alleged to be excavated unauthorizedly has been arrived at.

5. In view of the foregoing, without going into the merits of the case, this Court deems it appropriate to set aside the impugned order, dated 21.03.2024 and remand the matter to the respondent No.3 directing
3 the respondent No.3 to pass appropriate orders pursuant to the show 09.02.2024, after considering the explanation submitted by the petitioner and after giving due opportunity of hearing to the petitioner and dispose of the same within a period of six (06) weeks from the date of receipt of this order.
6. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs. notice, dated cause all pending miscellaneous applications shall stand As a sequel. closed.
