JUSTICE SUDESH BANSAL (V. J.) Order 27/06/2025 1. Instant anticipatory bail application has been filed by petitioners, apprehending their arrest in connection with FIR No.43/2025 registered at Police Station Kaithoon, Kota for the offences under Sections 189(2), 126(2), 127(2), 115(2), 117(2), 332(c), 303(2), 324(1)(4) & 110 of BNS. 2. Counsel for petitioners submits that petitioners are women, having no criminal antecedents and there is no specific allegation against any of the petitioners to cause injury. Other co-accused have been released on bail after their arrest; custodial [2025:RJ-JP:23683] (2 of 3) [CRLMB-7295/2025] investigation of petitioners is not required, therefore, in such circumstances, petitioners be granted benefit of pre-arrest bail. 3. Learned Public Prosecutor and counsel for complainant have opposed the bail application. It has been pointed out that petitioners along with other co-accused, having ill motive, entered into the house of complainant and cause grievous injuries to Kaushal and Rekha. One of the injured, Rekha was pregnant and she suffered severe injuries. In such circumstances, present anticipatory bail application is liable to be dismissed. 4. Heard learned counsel for the petitioners, counsel for complainant as well as learned public prosecutor and perused the material available on record. 5. Having considered the rival contentions of both parties and from perusal of FIR and impugned order, this Court finds that the manner in which the incident of scuffle occurred between the women parties; one of the injured, Rekha was pregnant and suffered grievous injures, therefore, this Court does not deem it fit and proper to grant benefit of pre-arrest of bail to petitioners, merely because they are women. 6. However, after arguing for some time and having instructions of petitioners, counsel for petitioners does not want to press this bail application and states that petitioners are ready to surrender before the concerned Court by their own, in case their regular bail application is directed to be decided on the same day. 7. In view of above, the bail application is dismissed as not press. In case petitioners surrender themselves before the concerned Court within a period of 15 days from today and move [2025:RJ-JP:23683] (3 of 3) [CRLMB-7295/2025] a regular bail application which is to be filed before 12.00 PM of working day, the concerned Court may make an endeavor to decide the bail application expeditiously as early as possible, on the same day, if possible. 8. However, petitioners shall not be arrested till 15 days’ from today or upto date of surrender within such period. (SUDESH BANSAL (V. J.)),J Sachin/78
